Clients seeking guidance for an estate settlement come to ProFiduciary with many questions about navigating an unfamiliar process. Our staff of experts has answers and provides guidance, offering independent, impartial administration of the process that strictly adheres to the governing document(s) and California law.
During the process, ProFiduciary provides for the custody and safekeeping of all assets, documents and records, as well as the registration of all assets in the name of the fiduciary, its depository or nominee.
During an estate settlement, ProFiduciary staff members will:
- Oversee the collection, allocation and distribution of all trust income and principal according to the terms of the governing document(s) and California law
- Issue periodic accounting statements and investment reports to trust beneficiaries
- Independently supervise the portfolio manager, including investment monitoring and reinvestment of trust cash
- Provide a policy statement of investment guidelines and objectives for the trust
- Write investment recommendations to co-fiduciaries or other outside advisors
- Take action on capital changes, corporate reorganizations, proxies and maturing items
- Coordinate the preparation and filing of the clients' personal income tax returns and trust fiduciary tax returns, as necessary
- Coordinate the preparation and filing of estate and/or gift tax returns, as necessary
- Provide supervision of property manager, tenant relations and lease/rental negotiations
- Provide supervision of real estate property maintenance, repairs and capital improvements
- Provide supervision of real estate sales, acquisitions and 1031 tax-deferred exchanges
- Oversee the collection of rental income, royalty income and tenant reimbursements
- Supervise the payment of real property taxes, insurance, mortgages and other related expenses
